JSDaerial operates as the sole Data Controller for all personal information collected through this website and during subsequent business interactions.

Identity and Contact Data: Your full name, company name (if applicable), email address, and phone number provided via our contact or booking forms.
Project and Logistics Data: Project site addresses, operational coordinates, specific content requirements, and preferred timelines necessary for flight planning.
Financial Data: Invoicing details, bank account numbers, and corporate identification required to process payments.
3. Purpose and Legal Basis for Processing
We process your personal data based on the following legal frameworks:
Contractual Necessity: To provide cost estimates, plan flight logistics, execute drone operations, and deliver final creative assets as agreed upon in our project brief.
Legal Obligations: To comply with Norwegian accounting laws (Bokføringsloven) regarding invoice retention, and civil aviation documentation mandates.
Legitimate Interests: To maintain communication, manage customer relationships, and improve our creative service workflows.
4. Data Sharing, Retention, and Security
Third-Party Disclosure: JSDaerial does not sell, lease, or share your personal data with third-party advertisers or external marketing platforms. Data is only shared with trusted sub-processors (such as accounting software or cloud delivery platforms) directly involved in executing your project.
Data Retention: We retain your personal data and communication history for as long as necessary to fulfill the purposes outlined or to satisfy legal, accounting, and reporting requirements.
Data Security: We implement appropriate technical and organizational measures to safeguard your personal data against unauthorized access, loss, or alteration.
5. Your Legal Rights
Under GDPR and Norwegian law, you possess the following rights regarding your data:
The right to request access to and a copy of your personal data.
The right to rectify incomplete or inaccurate information.
The right to request the complete deletion of your data, provided it does not conflict with statutory retention laws (e.g., accounting records).
The right to withdraw consent to data processing at any time.
1. Scope of Agreement and Corporate Identity
These Terms & Conditions constitute a legally binding agreement between JSDaerial (referred to as “the Contractor”) and the individual or corporate entity booking the services (referred to as “the Client”). By confirming a project brief, making a deposit, or authorizing a flight, the Client fully accepts these terms.
Operating Address: Located in Bærum, operating across the Oslo and Akershus regions.
2. Operational Safety, Regulation, and Flight Permits
Regulatory Compliance: JSDaerial operates strictly under European Union Aviation Safety Agency (EASA) and Civil Aviation Authority Norway (Luftfartstilsynet) regulations. The pilot in command maintains all necessary certifications, operational competencies, and legal drone registrations.
Pilot Authority: The pilot retains absolute, non-negotiable authority regarding flight safety. If a flight is deemed unsafe due to airspace restrictions, proximity to critical infrastructure, temporary flight restrictions (NOTAMs), or local hazards, the flight will be modified or declined.
Access and Permissions: The Client is solely responsible for obtaining ground access permissions, property owner consents, and indoor filming approvals necessary for the project location. JSDaerial will handle official airspace notifications and coordinate with local air traffic control where required.
3. Weather Clause and Cancellations
Weather Postponement: Drone operations are highly dependent on meteorological conditions (including but not limited to heavy rain, snow, high winds, and low visibility). JSDaerial reserves the exclusive right to postpone a flight if weather conditions compromise safety or equipment integrity.
Rescheduling: In the event of a weather-related postponement, JSDaerial will reschedule the operations to the next mutually available date at no additional cost to the Client.
Client Cancellations: If the Client cancels the project within 48 hours of the scheduled flight time for non-weather reasons, JSDaerial reserves the right to retain the 50% booking deposit to cover scheduling losses and flight preparation costs.
4. Payment Terms, Rates, and Deadlines
Booking Deposit: A mandatory deposit of 50% of the total estimated project value is required to secure the operational date and initiate flight planning.
Final Invoicing: The remaining balance will be invoiced upon the successful completion and digital delivery of the agreed-upon assets.
Payment Deadline: Final invoices are strictly payable within 14 days from the invoice issuance date for standard projects. For long-term, multi-phase, or corporate contracts spanning over several weeks, a customized payment milestone schedule must be formalized in the initial project brief.
Late Payments: Delays in payment are subject to late interest fees and debt collection penalties in accordance with the Norwegian Act on Interest on Overdue Payments (Forsinkelsesrenteloven).
5. Intellectual Property, Copyright, and Usage Rights
Commercial License: Upon receipt of full and final payment, JSDaerial grants the Client a perpetual, worldwide, non-exclusive, and non-transferable commercial license to use, publish, distribute, and display the delivered media assets for marketing, corporate, and promotional purposes.
Raw Footage: The delivered assets consist solely of the finalized, edited media specified in the project brief. All unedited raw footage, design project files, and raw data remain the exclusive intellectual property of JSDaerial unless a specific corporate buyout fee is negotiated and signed by both parties.
Portfolio Rights: JSDaerial retains the right to use any portion of the captured footage or finalized assets for self-promotion, website portfolios, social media showcases, and reel demonstrations. If the Client requires complete confidentiality, a formal Non-Disclosure Agreement (NDA) must be requested and signed prior to the flight.
6. Limitation of Liability and Insurance Coverage
Insurance: JSDaerial maintains valid commercial third-party liability insurance coverage explicitly tailored for commercial drone operations, meeting all statutory Norwegian requirements.
Financial Cap: To the maximum extent permitted by Norwegian law, the total collective liability of JSDaerial for any direct claims, losses, damages, or legal expenses arising out of the performance or non-performance of services shall be strictly capped at the exact total monetary amount paid by the Client for that specific project.
Exclusion of Indirect Loss: JSDaerial shall under no circumstances be held liable to the Client or any third party for indirect, incidental, special, or consequential damages, including but not limited to loss of business profits, loss of commercial data, business interruption, or reputational damage.
7. Force Majeure
Neither party shall be held legally responsible or liable for any failure or delay in performing its contractual obligations if such failure is caused by circumstances entirely beyond their reasonable control. These circumstances include, but are not limited to: acts of God, sudden government or aviation authority restrictions, military actions, geopolitical airspace closures, strikes, widespread epidemics, or catastrophic technical infrastructure failures.
8. Governing Law and Dispute Resolution
This Agreement, and any legal disputes or claims arising out of its execution, shall be governed by, interpreted, and construed exclusively in accordance with the laws of the Kingdom of Norway. Any legal disputes that cannot be settled through amicable, good-faith negotiations shall be submitted to the exclusive jurisdiction of the local district court covering Bærum, Norway (Asker og Bærum tingrett).
